From the Department of I Was Worried Enough About Obamacare Already, Thanks: the Catholic Health Association, a key ally of the Obama administration in passing the Affordable Care Act, has changed its mind about supporting the compromise on birth control coverage. That was the ?miraculous? accommodation that ensured no-cost contraceptive coverage to employees of religiously affiliated organizations, while making insurers, rather than the religious employers, responsible for picking up the tab. When the compromise was offered in February, CHA gave initial support. But CHA has now sent a letter to the Department of Health and Human Services opposing the compromise.

In an interview with Kaiser Health News?s Mary Agnes Carey, Sister Carol Ann Keehan, head of CHA, says:

I wouldn?t say as much as we withdrew support. What we said very clearly was that it is just too cumbersome. And I?ll tell you why.

Many, many, many of our organizations offer a choice in health coverage to their staffs. So they would have two different ways of dealing with their employees on this issue and, quite frankly, many of our members were hearing from local insurance companies and agents that ?well, we may not carve out explicitly how we?re charging you for this but there is no free lunch and you are going to pay for it one way or the other.? That was exactly what the goal was not. The goal was to not pay. And that?s not the fault of the White House. That?s the reality of the marketplace.

Here?s another reality of the marketplace: religious hospitals, like non-religious hospitals, rely on public funding for about half their operating revenues. Despite the religious affiliation, reports MergerWatch, ?little or none of the operating funds of these religious hospitals come from churches or other religious sources.? The reach of sectarian hospitals is vast: MergerWatch found that in 1999, religiously affiliated hospitals were operating one in every five acute care community hospital beds in the United States. And while Catholic hospitals may have been founded to cater to the spiritual needs of Catholics, by 2012 religiously affiliated hospitals are deeply embedded in diverse communities and in insurance plans. ?This complaint is a red herring,? says Sharon Levin, Director of Federal Reproductive Health Policy at the National Women?s Law Center. ?Women have a right under this law to needed healthcare, including contraception. How to avoid doing that should not be the focus.?

CHA?s letter makes clear the pitfalls of pandering to ?religious freedom? concerns in setting public policy. ?If an institution chooses to participate in secular activities, and hires people who are not co-religionists, they should be held to the same standard as other employers,? says Levin. ?Religion not a license to discriminate.?

At issue is not only contraceptive coverage. CHA is also concerned about what institutions count as ?religious??a designation that has ramifications that reach far beyond the birth control issue. While Obama?s compromise required hospitals, schools, and social service agencies with religious affiliations to provide contraceptive coverage, it exempted houses of worship as ?religious institutions.? According to its letter to HHS, CHA would like to see an institution considered ?religious? ?if it shares common religious bonds and convictions with the church.?

That?s a stretch. ?It is very important that the administration resist the request for a broader religious exemption that would cover entities that are not themselves religions but have vague ?bonds? to a religion or are motivated by faith,? says Frances Kissling, former head of Catholics for Choice. ?CHA claims that running hospitals is an integral part of living the teachings of Jesus. One can care for the sick and the impoverished in many ways besides controlling one-sixth of the hospital beds in the US.?

Meanwhile, the birth control mandate remains popular. A just-released poll found that nearly three-quarters of voters agree that cost should not be an obstacle to using birth control, including 66 percent of Catholic voters and 58 percent of evangelical voters.

Sources: Sandusky son was set to claim abuse

Sources tell NBC News that prosecutors warned the defense if they put Jerry Sandusky on the stand, his adopted son was prepared to provide damaging testimony as a surprise rebuttal witness. NBC's Michael Isikoff reports.

Jerry Sandusky decided not to testify in his child sex abuse trial after his lawyers were warned that prosecutors would call a surprise new witness ? one of the defendant?s own adopted sons, sources told NBC News. The man's lawyers said he?was prepared to testify that his father had abused him.

Matt Sandusky, one of six adopted children of Jerry and Dottie Sandusky, was observed by NBC News entering the courthouse, accompanied by Pennsylvania state troopers, on Wednesday morning as the defense was preparing to wrap up its case ? and apparently still wrestling with whether Jerry Sandusky, the former Penn State defensive coordinator, would take the stand.

NBC News was unable to locate him this week for comment. But his attorneys, Andrew Shubin and Justine Andronici, confirmed that Matt Sandusky requested their assistance in arranging a meeting with prosecutors "to disclose for the first time in this case that he is a victim of Jerry Sandusky's abuse."

Shubin and Andronucci said in a statement that they would have no further comment.

"This has been an extremely painful experience for Matt and he has asked us to convey his request that the media respect his privacy," they said.

Prosecutors contacted Sandusky?s defense lawyers in the last few days to inform them that Matt Sandusky might be called as a rebuttal witness if Sandusky testified in his own defense ? news that alarmed the defense team and introduced a new wild card into their intense discussions about whether he should do so, said the sources, who spoke on condition of anonymity.

A source close to Jerry Sandusky told NBC News that "there was no one factor that led to the decision" not to have him testify Wednesday. Sandusky's lawyers were also known to be concerned that the defendant would be grilled on cross examination about apparently incriminating statements he made to NBC's Bob Costas in the "Rock Center with Brian Williams" show last November, including unaired portions that were played on the "Today" show for the first time this week. Defense lawyers also believed they had made some headway chipping away at the prosecution case this week, especially by playing a tape showing that police investigators may have coached Sandusky's alleged victims by telling them what other witnesses were saying about him.

The drama over whether Sandusky would take the stand continued to play out in court on Wednesday as defense lawyers were finishing their case. During a court recess in the morning, Sandusky's lawyers motioned Sandusky to enter a side room for a conference. They then joined prosecutors for a second conference behind closed doors meeting in Judge John Cleland's chambers. About 30 minutes later, Sandusky re-entered the courtroom, looking somber and chastened. At that point, Sandusky's lawyer rose and announced, "The defense rests."

Matt Sandusky first met his father at his Second Mile charity when he was 10 years old. He later went to live in the Sandusky home after he set fire to a barn in 1995. A judge approved the Sanduskys as foster parents for Matt and he was formally adopted by the couple when he was 18.

Matt Sandusky has been named during testimony in the trial. During the first day of testimony, one of the alleged victims ?listed in the grand jury report as "Victim 4" ? testified that Matt Sandusky seemed "nervous" when, after they played racketball with Jerry Sandusky, the three showered together and Jerry Sandusky then began throwing soap at him, "Victim 4" testified.

"At that point, Matt got up and left," he testified. "Well, not got up, but turned off the shower, went out and into another shower."

Melting sea ice threatens emperor penguins

ScienceDaily (June 20, 2012) ? At nearly four feet tall, the Emperor penguin is Antarctica's largest sea bird -- and thanks to films like "March of the Penguins" and "Happy Feet," it's also one of the continent's most iconic. If global temperatures continue to rise, however, the Emperor penguins inTerre Ad?lie, in East Antarcticamay eventually disappear, according to a new study by led by researchers from the Woods Hole Oceanographic Institution (WHOI).

The study was published in the June 20th edition of the journal Global Change Biology.

"Over the last century, we have already observed the disappearance of the Dion Islets penguin colony, close to the West Antarctic Peninsula," says Stephanie Jenouvrier, WHOI biologist and lead author of the new study. "In 1948 and the 1970s, scientists recorded more than 150 breeding pairs there. By 1999, the population was down to just 20 pairs, and in 2009, it had vanished entirely." Like in Terre Ad?lie, Jenouvrier thinks the decline of those penguins might be connected to a simultaneous decline in Antarctic sea ice due to warming temperatures in the region.

Unlike other sea birds, Emperor penguins breed and raise their young almost exclusively on sea ice. If that ice breaks up and disappears early in the breeding season, massive breeding failure may occur, says Jenouvrier. "As it is, there's a huge mortality rate just at the breeding stages, because only 50 percent of chicks survive to the end of the breeding season, and then only half of those fledglings survive until the next year," she says.

Disappearing sea ice may also affect the penguins' food source. The birds feed primarily on fish, squid, and krill, a shrimplike animal, which in turn feeds on zooplankton and phytoplankton, tiny organisms that grow on the underside of the ice. If the ice goes, Jenouvrier says, so too will the plankton, causing a ripple effect through the food web that may starve the various species that penguins rely on as prey.

To project how penguin populations may fare in the future, Jenouvrier's team used data from several different sources, including climate models, sea ice forecasts, and a demographic model that Jenouvrier created of the Emperor penguin population at Terre Ad?lie, a coastal region of Antarctica where French scientists have conducted penguin observations for more than 50 years.

Combining this type of long-term population data with information on climate was key to the study, says Hal Caswell, a WHOI senior mathematical biologist and collaborator on the paper.

"If you want to study the effects of climate on a particular species, there are three pieces that you have to put together," he says. "The first is a description of the entire life cycle of the organism, and how individuals move through that life cycle. The second piece is how the cycle is affected by climate variables. And the crucial third piece is a prediction of what those variables may look like in the future, which involves collaboration with climate scientists."

Marika Holland of the National Center for Atmospheric Research is one such scientist. She specializes in studying the relationship between sea ice and global climate, and helped the team identify climate models for use in the study.

Working with Julienne Stroeve, another sea ice specialist from the National Snow and Ice Data Center, Holland ultimately recommended five distinct models. "We picked the models based on how well they calculated the sea ice cover for the 20th century," she says. "If a model predicted an outcome that matched what was actually observed, we felt it was likely that its projections of sea ice change in the future could be trusted."

Jenouvrier used the output from these various climate models to determine how changes in temperature and sea ice might affect the Emperor penguin population at Terre Ad?lie. She found that if greenhouse gas emissions continue to rise at levels similar to today -- causing temperatures to rise and Antarctic sea ice to shrink -- penguin population numbers will diminish slowly until about 2040, after which they would decline at a much steeper rate as sea ice coverage drops below a usable threshold.

"Our best projections show roughly 500 to 600 breeding pairs remaining by the year 2100. Today, the population size is around 3000 breeding pairs," says Jenouvrier.

The effect of rising temperature in the Antarctic isn't just a penguin problem, according to Caswell. As sea ice coverage continues to shrink, the resulting changes in the Antarctic marine environment will affect other species, and may affect humans as well.

"We rely on the functioning of those ecosystems. We eat fish that come from the Antarctic. We rely on nutrient cycles that involve species in the oceans all over the world," he says. "Understanding the effects of climate change on predators at the top of marine food chains -- like Emperor penguins -- is in our best interest, because it helps us understand ecosystems that provide important services to us."

Also collaborating on the study were Christophe Barbraud and Henri Weimerskirch of the Centre d'Etudes Biologiques de Chiz?, in France, and Mark Serreze of the National Snow and Ice Data Center in the United States.

Iran impasse to stir sanctions pressure, tensions

MOSCOW/LONDON (Reuters) - Western diplomatic efforts to curb Iran's nuclear program may not have breathed their last but the troubled process appears to be on life support after talks this week failed to resolve a row stirring regional tensions and unsettling oil markets.

Mindful of a possible Israel strike, both Iran and its negotiating partners are keen to pursue even a minimal level of contact to shore up the process despite the failure of the negotiations in Moscow on Monday and Tuesday.

A technical discussion is scheduled for July 3 in Istanbul, but no further political talks have been agreed. The West, suspicious Tehran is working towards a nuclear bomb, is due to introduce hard-hitting trade sanctions in the two weeks before that.

"Diplomacy in now on a respirator," said Cliff Kupchan of the Eurasia Group consultancy. "Both sides underestimated the difficulty of moving talks forward. How little progress was made underlines how far apart the sides are on substance."

U.S.-based Iran expert Trita Parsi said if a compromise was not vigorously pursued, "war will become far more likely."

"It really does seem like the Iranians just haven't made the decision to accept limits on their nuclear program," a Western diplomat said.

"If they haven't made that decision then all the talking in the world really isn't going to get us anywhere."

"Iran really pressed for this experts meeting and Russia wanted it so we agreed to do it. It doesn't feel to us like there is a lot of progress that is going to be made even there.

"(But) nobody is going to shut the door entirely."

The six powers - the United States, China, Russia, France, Britain and Germany - want Iran to scale back its nuclear work and, in particular, stop enriching uranium to levels that could bring it close to making an atom bomb.

Last month, and again in Moscow, the powers asked Tehran to shut down the Fordow underground facility where uranium is being enriched to the 20-percent level of fissile purity and ship any stockpile out of the country.

IRAN SEEKS SANCTIONS RELIEF

In return, they have offered fuel to keep Iran's medical isotope reactor running, assistance in nuclear safety and an end to a ban on spare parts for Iran's ageing civilian aircraft.

Iran denies its work has any military purpose and says the powers should offer it relief from sanctions and acknowledge its right to enriching uranium before it meets their demands.

New U.S. and European sanctions are due to come into effect in the next two weeks. In addition to totally banning Iranian oil imports, the EU measures prohibit European insurers from covering Iranian oil exports anywhere in the world, which would leave importers exposed to personal injury and pollution claims.

Western officials are suggesting that even further punitive measures may now be in prospect.

After the Moscow discussions broke up, a senior U.S. administration official said the talks would not go on indefinitely and Tehran should expect more sanctions if it fails to address international suspicions over the nature of its work.

"Sanctions will be increasing. We have told the Iranians there will be more pressure coming if this (lack of progress) proceeds forward," the official said, speaking on condition of anonymity.

There was no immediate world from Israeli officials on the failure of the Moscow talks.

PRESSURE WILL RATCHET UP

But on June 4, a U.S. official was quoted as saying the United States was conferring with Israel about new sanctions planned against Iran should the Moscow talks fail.

"If we don't get a breakthrough in Moscow there is no question we will continue to ratchet up the pressure," said David Cohen, U.S. Treasury undersecretary for terrorism and financial intelligence, Haaretz newspaper reported.

The comment offered a strong hint that Washington is continuing to apply the brakes on any plan by Israel to attack Iranian nuclear facilities preemptively.

In Paris, Foreign Minister Laurent Fabius said France would continue to strengthen sanctions against Iran. Some analysts say they suspect U.S. President Barack Obama, seeking a second term in November elections, cannot afford politically to make concessions to Tehran right now.

TALKS SEEN AVERTING ISRAELI STRIKE RISK

The Democratic White House has strongly rejected a Republican charge that Obama, who sought to ease 30 years of enmity with Iran after he came to power in early 2009, has shown a lack of resolve abroad.

Bijan Khajehpour, an Iranian and managing partner of Atieh International, a Vienna-based consultancy on the Middle East, told Reuters there were two reasons why the two sides were prepared to engage without a clear result.

One of them was that the continuation of such contacts, both sides calculated, reduced the risk of an Israeli strike.

The other reason was that either side suspected time would change the strategic situation in their favor.

"Western governments think the sanctions will bite further, Iran will come to its knee and then it will be more willing to compromise," he said. "From the Iranian perspective, the Americans have an election and it is not clear whether Obama will win 'so let's just wait and see what happens'."

Meir Javedanfar, lecturer on Iranian politics at Interdisciplinary Center in Herzliya, Israel, said that despite the failure of the Moscow gathering diplomacy was not dead.

Neither side would want to show that it was not interested in diplomacy as the costs at home and abroad would be high, he said. "It just means that for this route to succeed, more time and effort will be needed. Until then, both sides will try to use their own leverages to pressure the other side to compromise at the next round, whenever that may be."
